Article 2 — Products and Origin
Lumicorne sells custom LED neon signs and illuminated panels. Products are manufactured by partner manufacturers located in Asia (primarily China) and shipped directly from their production site. Lumicorne manages customer relations, customization, production monitoring, after-sales service, and logistics from France.
The products offered comply with current French and European regulations, including:

Large signs — delivered in multiple parts
Lumicorne illuminated signs are mounted on plexiglass (PMMA) sheets whose manufacturing dimensions are technically limited. Consequently, any sign whose height or width reaches or exceeds 120 cm is manufactured and delivered in several parts (modules) designed to be assembled. This configuration, inherent in the manufacturing process and the maximum size of plexiglass sheets, does not constitute a non-conformity. It is brought to the customer's attention on the relevant product page as well as during the validation of the proof (BAT), prior to any commitment.
Article 3 — Pricing
Prices are displayed in euros, all taxes included, in accordance with the decree of December 3, 1987, concerning consumer price information. As Lumicorne is an individual entrepreneur not subject to VAT under Article 293 B of the CGI, the mention "VAT not applicable, art. 293 B of the CGI" applies to all displayed prices.
The displayed prices include all costs borne by the consumer: product value, customs duties and import taxes, standard delivery costs for mainland France and the European Union. For any order delivered in mainland France or the European Union, no additional costs, of any kind whatsoever, will be requested from the consumer upon receipt of the product. Deliveries outside the European Union are subject to special conditions expressly mentioned in the order (see Article 6).
Lumicorne reserves the right to modify its prices at any time. The applicable price is that indicated at the time of order validation.
When reference prices (struck-through prices) are displayed, they correspond to the lowest price practiced by Lumicorne during the 30 days preceding the promotion, in accordance with Article L.112-1-1 of the Consumer Code.
Article 4 — Order
The customer's validation of the order implies unreserved acceptance of these General Terms and Conditions of Sale. The customer receives a confirmation email after finalizing their order. This email contains all the pre-contractual information required by Article L.221-5 of the Consumer Code and constitutes the durable medium within the meaning of Article L.221-13 of the same code.
For customized products, manufacturing begins after validation of the proof (BAT) by the customer. No modifications can be made after BAT validation.
Article 5 — Payment
Payment is due at the time of order. Accepted payment methods are:

Split payment in 3 or 4 interest-free installments via Klarna (subject to Klarna's approval)
Payment data is processed exclusively by PCI-DSS Level 1 certified providers. Lumicorne does not have access to the customer's full bank details.
Article 6 — Delivery
6.1 Delivery Zones
Lumicorne delivers to mainland France, the European Union, and internationally. Delivery to mainland France and the European Union is free and included in the displayed price. For deliveries outside the European Union, shipping costs may apply depending on the destination and are communicated to the customer before order validation.
6.2 Delivery Times
The delivery time is 5 to 7 working days from order confirmation or BAT validation for personalized products. This period includes manufacturing and transportation.
In the event of exceeding the maximum period of 30 days provided for by Article L.216-1 of the Consumer Code, the customer may terminate the contract by registered letter with acknowledgment of receipt or in writing on another durable medium, unless the delay is due to force majeure or a duly justified delay by the carrier.
6.3 Customs Regime
For deliveries to mainland France and the European Union, orders are shipped under Incoterm DDP (Delivered Duty Paid). Any customs duties and import taxes are entirely covered by Lumicorne and are already included in the price displayed at the time of order. The consumer is not required to pay any customs duties, import taxes, or customs clearance fees upon receipt of their package.
For deliveries outside the European Union or in overseas departments and regions (DOM-TOM), customs duties and import taxes may be payable upon receipt and are then the responsibility of the recipient, unless otherwise expressly stated at the time of order. These specific conditions are communicated to the customer before their order is validated. Lumicorne cannot be held responsible for refusal of delivery resulting from non-payment of these duties by the recipient for deliveries outside the European Union only.
Article 7 — Right of Withdrawal
7.1 Principle
In accordance with Articles L.221-18 et seq. of the Consumer Code, the consumer customer has a period of 14 calendar days from receipt of the product to inform Lumicorne of their decision to withdraw, without having to provide any reason or pay any penalty.
For standard (non-customized) products, the exercise of the right of withdrawal is not subject to any prior acceptance condition by Lumicorne.
7.2 Exception — Personalized Products
In accordance with Article L.221-28 3° of the Consumer Code, the right of withdrawal does not apply to contracts "for the supply of goods manufactured according to the consumer's specifications or clearly personalized".
Custom Lumicorne signs (personalized text, logo, specific design, adapted dimensions) are therefore excluded from the right of withdrawal as soon as manufacturing has started after the customer's validation of the proof (BAT).
This exclusion is explicitly stated on each relevant product page and on the order validation page, clearly and understandably before the customer's commitment.
7.3 Exercise Modalities and Deadlines
To exercise their right of withdrawal in cases where it applies, the customer has two distinct deadlines:

The customer has 14 calendar days from receipt of the product to notify Lumicorne of their decision to withdraw, by email to contact@lumicorne.com using the standard form below, or by any other unambiguous statement.

Once this decision has been notified, the customer has a further 14 days to return the product to Lumicorne. This second period runs from the date on which the customer communicated their decision to withdraw.
In accordance with Article L.221-23 of the Consumer Code, the customer may handle the product to the extent necessary to establish the nature, characteristics, and proper functioning of the goods. Only depreciation resulting from handling exceeding this scope may give rise to compensation.
Return costs are the responsibility of the customer.

Article 8 — Guarantees
8.1 Legal Guarantee of Conformity
In accordance with Articles L.217-3 et seq. of the Consumer Code, Lumicorne is obliged to deliver a product that conforms to the contract and is liable for any conformity defects existing at the time of delivery.
In the event of a lack of conformity, the customer may obtain the conformity of the product (repair or replacement) or, failing that, a price reduction or termination of the contract. The legal guarantee of conformity is 2 years from the delivery of the product.
The customer does not have to prove the existence of the lack of conformity for 24 months following the delivery of the goods.
As part of the implementation of this legal guarantee of conformity, Lumicorne ensures: new replacement in case of manufacturing defect, full coverage of return costs for the product concerned, dedicated follow-up by a single point of contact (Pablo, reachable via WhatsApp) and intervention within 10 working days from receipt of the request. The guarantee is implemented by email to contact@lumicorne.com with a description of the defect and supporting photos.
8.2 Legal Guarantee Against Hidden Defects
In accordance with Articles 1641 et seq. of the Civil Code, Lumicorne is bound by the guarantee against hidden defects in the sold item that render it unfit for its intended use, or that diminish this use so much that the buyer would not have acquired it, or would have paid a lesser price, had they known about them.
The action for hidden defects must be brought within 2 years from the discovery of the defect.
8.3 Reproduction of the Annex to Article D.211-2 of the Consumer Code
In accordance with the provisions of the Consumer Code, the full text of the annex to Article D.211-2 is reproduced below:
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.
When the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee applies to this digital content or digital service throughout the envisaged supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date of its appearance.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all necessary updates to maintain the conformity of the goods.
The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer can obtain a price reduction by keeping the goods or terminate the contract by obtaining a full refund in exchange for returning the goods, if:

The professional refuses to repair or replace the goods;

The repair or replacement of the goods occurs after a period of thirty days;

The repair or replacement of the goods causes significant inconvenience to the consumer, especially when the consumer permanently bears the costs of taking back or removing the non-conforming goods, or if they bear the installation costs of the repaired or replacement goods;
-
The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer also has the right to a reduction in the price of the goods or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or contract termination. The consumer is then not required to request repair or replacement of the goods beforehand.
The consumer does not have the right to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilized for repair or replacement suspends the remaining guarantee until the restored goods are delivered.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
A seller who maliciously obstructs the implementation of the legal guarantee of conformity faces a civil fine of up to 300,000 euros, which can be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects in application of Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept or to a full refund in exchange for returning the goods.
Article 9 — Returns and Refunds
To facilitate the processing of your return, please notify Lumicorne by email at contact@lumicorne.com so that we can provide you with the most suitable return address and prepare your case. This prior contact is in no way a condition for exercising your right of withdrawal or legal guarantees.
The product must be returned in its original packaging in a condition that allows it to be resold.
Return costs are the responsibility of the customer when exercising the right of withdrawal, in accordance with Article L.221-23 of the Consumer Code. In case of non-conformity, hidden defect, or error by Lumicorne, return costs are fully covered by Lumicorne.
Refunds are made using the same payment method as used for the purchase, within a maximum of 14 days following receipt of the returned product or proof of its shipment, in accordance with Article L.221-24 of the Consumer Code.
Personalized products fall under the legal exclusion provided for in Article L.221-28 3° of the Consumer Code and cannot be returned under the right of withdrawal. They remain covered by legal guarantees of conformity and hidden defects.

Article 10 — Liability
Lumicorne is responsible for the proper execution of the contractual obligations provided for in these GTC. Its liability is engaged in accordance with the provisions of common law.
Lumicorne cannot be held responsible for:

Damages resulting from non-compliant use of the product by the customer

Damages resulting from an unforeseeable and irresistible external cause

Cases of force majeure (strike, natural disaster, duly justified carrier delay)
For deliveries outside the European Union only, Lumicorne cannot be held responsible for customs blockage attributable to the recipient who refuses to pay import duties and taxes.
These clauses do not affect the mandatory provisions of consumer law protecting the consumer.
Article 11 — Intellectual Property
All elements of the Lumicorne website (texts, graphics, logos, images, videos, layouts) are the exclusive intellectual property of PARANT Grégoire / Lumicorne. Any reproduction, representation, or use, even partial, of the elements of the site without prior written authorization is strictly prohibited and constitutes an infringement punishable by articles L.335-2 et seq. of the Intellectual Property Code.
Custom designs ordered by professional clients remain their property. However, Lumicorne has a right to use photographs of the finished product for commercial communication purposes, unless the client expressly objects.
Article 12 — Personal Data
The personal data collected during the order is necessary for its processing and delivery. In accordance with the General Data Protection Regulation (GDPR No. 2016/679) and the amended Data Protection Act, the customer has a right of access, rectification, erasure, restriction, portability, and opposition regarding their personal data.
To exercise these rights, the customer can contact Lumicorne at contact@lumicorne.com. Lumicorne undertakes to respond within a maximum of 30 days.
The detailed terms of data processing are specified in the Privacy Policy available on the website.
Article 13 — Mediation and Disputes
13.1 Prior Complaint
In case of dispute, the customer is invited to first contact Lumicorne customer service at contact@lumicorne.com or at 07 83 49 94 68 (Mon-Fri, 9am-6pm). Lumicorne undertakes to respond to any complaint within 48 business hours.
13.2 Consumer Mediation
In accordance with articles L.612-1 et seq. of the Consumer Code, after having contacted Lumicorne customer service and in the absence of a satisfactory response within two months, the consumer may have recourse free of charge to a mediation procedure with the following organization:

The mediator must be contacted within a maximum period of one year from the written complaint addressed to the professional.
13.3 European Online Dispute Resolution Platform
In accordance with Article 14 of European Regulation 524/2013, the customer can also submit their dispute to the European online dispute resolution platform accessible at the following address: https://ec.europa.eu/consumers/odr/
13.4 Applicable Law and Jurisdiction
These GTC are subject to French law. In the absence of an amicable resolution, any dispute falls under the jurisdiction of the competent French courts according to the rules of the Code of Civil Procedure.
Article 14 — Final Provisions
If any stipulation of these GTC were declared null or unenforceable by a court decision, the other stipulations would remain fully in force.
The fact that Lumicorne does not at any given time invoke any of these conditions cannot be interpreted as a waiver of the right to avail itself of them later.
These GTC may be modified at any time. The applicable version is the one in force on the date of the order.
